If you are a New York employer then you are quickly approaching the deadline to comply with the newly enacted infectious disease prevention requirements imposed by the State of New York.
The state’s Health & Essential Rights Act is a new enforceable regulation, known as the HERO Act, and constructs safety and health standards aimed at mitigating COVID-19 and other infectious diseases in the workplace. Employers must produce and implement prevention plans and create safety committees. Here's some important information you should know:
• Department of Labor (DOL) model standards: https://dol.ny.gov/ny-hero-act
• Employers have 30 days to adopt the standards; by August 5, 2021. Currently, per the DOL, while employers must adopt plans as required by the law, as of July 27 no designation has been made and plans are not required to be in effect.
• Employers have an additional 30 days to communicate the adopted standards to employees; by September 4, 2021
• Joint labor-management workplace safety committees shall be allowed after 180 days; on or after November 1, 2021
